Terms of service

1. Accepting these terms

By using the website at eastlinkmedia.com (the "Site") or hiring Eastlink Media for any work, you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Site or our services.

These Terms apply to visitors to the Site and to clients. Each project is also covered by a separate written agreement (a quote, Statement of Work or Service Agreement). If that agreement and these Terms conflict, the agreement takes precedence.

2. About Eastlink Media

Eastlink Media provides brand positioning, website design and build, SEO and generative engine optimisation (GEO), LinkedIn and digital outreach, trade show strategy and follow-up, and cross-cultural sales training. It also designs logos, makes launch videos and supplies branded merchandise.

Sourcing, fulfilment and shipping are provided by separate companies, China Factory Sourcing, China Fulfillment and Parcel From China, under their own terms. When you ask us about those services, we put you in touch with the right company.

3. Using the website

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that breaks local, national or international law
• Send unsolicited or unauthorised advertising through it
• Try to gain unauthorised access to the Site or the systems behind it
• Do anything that stops other people using or enjoying the Site
• Scrape, crawl or extract data from the Site with automated tools without our written permission

4. Services, prices and the Grow guarantee

Prices on the Site are starting prices. We confirm a fixed price for your project in writing before any work starts, and the written agreement for your project sets out what's included.

The 25% results guarantee applies only to clients on the Grow plan, and only on the terms written into their Grow agreement, including the agreed baseline, the 90-day window and the eligibility conditions. Nothing else on the Site is a guarantee of specific results.

We may decline any project at our discretion.

5. Intellectual property

Everything on the Site, including text, graphics, logos, images, video and code, belongs to Eastlink Media or the people who licensed it to us, and is protected by copyright and other intellectual property law.

You may not copy, distribute, change or create derivative works from Site content without our written permission.

Client work

Who owns the work we create for you is set out in the written agreement for your project. Unless that agreement says otherwise, Eastlink Media keeps ownership of its own tools, frameworks, methods and any intellectual property it had before the project.

6. Confidentiality

Both sides agree to keep confidential any non-public information shared during a project that is marked as confidential, or that a reasonable person would treat as confidential. This doesn't apply to information that is already public, developed independently, or that the law requires to be disclosed.

7. Disclaimers

The Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.

We don't promise that the Site will be uninterrupted, error-free or free of viruses. Client results shown on the Site are real, but they describe what happened for those clients and don't predict your results. The only results guarantee we give is the Grow guarantee described in section 4.

8. Limitation of liability

As far as the law allows, Eastlink Media is not liable for any indirect, incidental, special, consequential or punitive losses, including lost profits, data or goodwill, arising from your use of the Site or our services, even if we were told such losses were possible.

Our total liability for any claim arising from these Terms or our services is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) €500.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law doesn't allow us to limit.

9. Indemnity

You agree to compensate Eastlink Media, its directors, employees and agents for any claims, losses, damages, liabilities and costs (including reasonable legal fees) that arise from your use of the Site, your breach of these Terms, or your breach of anyone else's rights.

10. Links to other websites

The Site links to other websites, including our clients' sites. We include those links for convenience. We don't control those sites and aren't responsible for them, or for any loss that comes from using them.

11. Privacy

Our Privacy Policy also applies when you use the Site and forms part of these Terms.

12. Changes to these terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. If you keep using the Site after a change, you accept the updated Terms.

13. Governing law

These Terms, and any dispute arising from them, are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any such dispute. If you're a consumer, this doesn't take away any protection you have under the law of the country where you live.
